PUBLIC NOTICE

Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Rules, the Commission hereby gives notice of Wyrulec Company’s (Wyrulec or the Cooperative) Application for authority to update its Miscellaneous Charges, Allowances and Avoided Cost Tariff; Wyoming PSC No. 2, 4th Revised sheet No. D-2R, as more fully described below.

1. Wyrulec is a public utility subject to the Commission’s jurisdiction. Wyo. Stat. §§ 37-1-101(a)(vi)(C) and 37-2-112. Wyrulec provides electric service to commercial, irrigation and residential members of Goshen, Platte, and Laramie County, Wyoming, and other counties in Nebraska, and is an all-requirements power supply consumer of Tri-State Generation and Transmission Association (Tri-State).

2. On June 18, 2024, Wyrulec submitted its Application requesting authority to update its Miscellaneous Charges, Allowances, and Avoided Cost Tariffs. The Cooperative is not subject to the Commission’s retail rate jurisdiction. Wyo. Stat §§ 37-17-103. Accordingly, the Commission lacks the authority to approve those portions of the Application that seek to implement retail rate increases or changes. The Application contains proposed revisions to the Cooperative’s Miscellaneous Charges, Allowances, and Avoided Cost Tariffs, which is subject to the Commission’s jurisdiction.

3. On May 22, 2024, Wyrulec's Board of Directors approved updated labor and transportation rates applicable to the Cooperative’s Miscellaneous Charges and Allowances, and Avoided Cost Tariff Sheets. The Cooperative based the proposed changes on the most current wages and overhead costs associated with work processes and assignments outlined in its tariffs. Transportation costs were updated to reflect costs for fleet maintenance and operating expenses based on data from January through December of 2023.

5. Anyone desiring to file a statement, intervention petition, protest or request for a public hearing in this matter must do so, in writing, on or before August 1, 2024. Petitions shall set forth the grounds of the proposed intervention or request for hearing as well as the position and interest of the petitioner in this proceeding.
