The Torrington City Council met in regular session on Tuesday, March 5, 2024 in the City Council Chambers at 436 East 22nd Ave. at 7:00 p.m. Present: Mayor Doby, Council Members Deahl, Kelly, Patterson and Viktorin. Also Present: Clerk/Treasurer Strecker, Attorney Eddington, Director of Public Works Harkins, Assistant Chief of Police Connelly, Water/Wastewater Supervisor Troxel and Deputy City Clerk Anaya.
Mayor Doby called the meeting to order.
Councilman Deahl led the Pledge of Allegiance.
Mayor Doby led the session with informational announcements on the following items: 1. Weather updates. Announcement that the City is busy getting ready for the spring and summer seasons. City crews and staff are working on the municipal pool, the golf course and the many parks and fields that the City owns and maintains. Mayor Doby urged the public to please enjoy the many recreational opportunities provided by the City of Torrington as the seasons progress; 2. Reminder that the City of Torrington is now accepting applications for seasonal employment. If interested, please call (307) 532-5666 or visit www.torringtonwy.gov for more information; 3. Reminder that the City of Torrington offers a TextMyGov service that allows citizens to receive City alerts and notifications on their cell phones and make inquiries to City staff by text. To get started text “Hi” to (307) 338-2802; 4. Reminder to the public to be cautious and mindful of the presence of pedestrians, bicyclists and motorcyclists on the streets as warmer weather approaches; and 5. Request to the public to refrain from using their cell phones while driving.

Councilman Kelly moved and Councilman Viktorin seconded to approve the consent agenda which includes the minutes from the 02-20-24 Council meeting as published and all actions therein be ratified. Motion carried unanimously.
Councilman Patterson moved and Councilman Deahl seconded to approve the agenda as presented. Motion carried unanimously.
Paul Stille with Leo Riley & Co. presented the Auditor’s Financial Report for FY 2023 ending 06-30-23. He briefly reviewed some of the major highlights of the report which included the statement of net position, net pension liability, the balance sheet, the statement of revenues, expenditures and changes in fund balances, the notes to the basic financial statements and the independent auditor’s report on internal control over financial reporting and on compliance. Councilman Patterson moved and Councilman Kelly seconded to accept the financial report as presented. Motion carried unanimously.
Kirk Haas with the Goshen County Republican Party requested a waiver of Section 3. v. of the Lincoln Community Complex Pony Express Room Rental Agreement relating to firearms for the events scheduled for 09-06-24 and 09-07-24. He stated that the events are Wyoming State Republican Central Committee meetings and indicated that different towns throughout the state who wish to host these quarterly meetings have to submit a bid to be the hosting town and get awarded that bid in order to do so. Mr. Haas commented that the bylaws of the Wyoming Republican Party Article I Section 2. 2.2 state that, “At no time will any body of the Wyoming Republic Party meet in any venue that denies the individual the rights guaranteed by the US Constitution 2nd Amendment or the Wyoming Constitution.” He stated that the waiver is being requested due to that specific segment of the bylaws. Mr. Haas indicated that the waiver needs to be acquired in order for the meeting to be hosted in Torrington. Councilman Viktorin inquired if the central committee is coming to Torrington regardless of the outcome of the waiver request. Mr. Haas responded no and commented that the bid has not been awarded yet. He stated that if the waiver is not granted, though, the Pony Express Room would not be able to be used as the meeting location in Torrington. Councilman Patterson stated that he has done a lot of research and read statutes pertaining to the subject being considered and indicated that the City not conceding the waiver does not violate the Wyoming Constitution or the 2nd Amendment. He commented that his concern is that the City has policy in place for a reason and stated that he believes it is a bad precedent to waive a policy. Councilman Patterson indicated that there is some potential liability that could arise as a result of firearms being allowed in the facility that he is also concerned about. He commented that his biggest concern, though, is the fact that the Pony Express Room is next to a daycare that will be in operation the first day that these meetings are scheduled to commence and stated that that is a line that he will not cross. Councilman Patterson indicated that he is not anti-guns but that there is a time and a place. Mayor Doby commented that he had an extensive conversation with Chief of Police Johnson and stated that he, as the Chief of Police, does not have any safety concerns about the waiver if it is granted. He asked Assistant Chief of Police Connelly if he had any safety concerns to which Assistant Chief of Police Connelly replied no. Councilman Viktorin moved and Mayor Doby seconded to approve the Lincoln Community Complex Pony Express Room Rental Agreement waiver as presented. Voting aye Doby and Viktorin, nay Deahl, Kelly and Patterson. Motion failed.
Attorney Eddington read by title AN ORDINANCE CREATING AND ENACTING CHAPTER 5.28 OF THE TORRINGTON MUNICIPAL CODE, 2024 REVISIONS, RELATING TO PERMITS – UTILITY WORK WITHIN CITY RIGHTS OF WAY. Councilman Deahl moved and Councilman Patterson seconded to approve Ordinance No. 1285 as presented on third reading. Motion carried unanimously.
Water/Wastewater Supervisor Troxel presented for approval a Marketing Agreement between the City of Torrington and Utility Service Partners Private Label, Inc. DBA Service Line Warranties of America. He stated that Service Line Warranties of America offers property owners the opportunity, but not the obligation, to purchase any of the following products: An external water service line plan, an external sewer/septic line plan or an interior plumbing and drainage plan. Water/Wastewater Supervisor Troxel indicated that the role that the City of Torrington would play in this is simply that of a partnership. Councilman Patterson inquired if this particular company is regulated by the Wyoming Department of Insurance. Water/Wastewater Supervisor Troxel replied that he would assume yes since they are very active in the state, he is not positive, but he will verify. He commented that if the agreement is approved, staff will work with Regional Director Dennis Lyon to customize the letter that will be sent to the constituents of the City of Torrington informing them of the warranty program. Water/Wastewater Supervisor Troxel stated that staff is working internally on customizing the letter to the point where the City of Torrington will be portrayed as only a partner supporting the program. Mayor Doby indicated that he and staff have had an in-depth meeting with Mr. Lyons and detailed discussions internally regarding the City wanting a specific measure of control over what marketing material is going to be sent out. He commented that the goal is to customize the material in a manner that makes it unquestionably clear that Service Line Warranties of America is selling the service not the City of Torrington. Clerk/Treasurer Strecker stated that another plus about the program is that local contractors will be utilized to perform the work for the claims that are submitted. Councilman Patterson moved and Councilman Deahl seconded to approve the Marketing Agreement between the City of Torrington and Utility Service Partners Private Label, Inc. DBA Service Line Warranties of America as presented. Motion carried unanimously.
The bills from 02-21-24 to 03-05-24 were presented for payment. Councilman Kelly moved and Councilman Viktorin seconded to approve the bills for payment as presented. Motion carried unanimously.
Mayor Doby asked for public comments, questions or concerns.
Councilman Deahl reminded the public that the FY 2024 Crack Fill Project is underway on East B Street and on East C Street.
Fire Chief Petsch briefly updated the Mayor and Council on the calls that the Torrington Volunteer Fire Department responded to in the last couple of weeks. He stated that a few members of the department attended the funeral of fallen Sheridan police officer Nevada Krinkee on 03-01-24. Fire Chief Petsch also reported that the Wyoming State Forestry is already talking about trying to get people to put fire restrictions in place.
Mayor Doby reminded residents who will be holding controlled burns to call the dispatch non-emergency line ahead of time to provide relevant information about the burn.
