    The Torrington City Council met in regular session on Tuesday, July 5, 2022 in the City Council Chambers at 436 East 22nd Ave. at 7:00 p.m. Present: Mayor Adams, Council Members Kelly, Patterson and Steinbock. Councilman Kinney was absent but excused. Also Present: Clerk/Treasurer Strecker, Attorney Eddington, Director of Public Works Harkins, Chief of Police Johnson, Buildings & Grounds Superintendent Estes and Deputy City Clerk Anaya.
    Mayor Adams called the meeting to order.
    Clerk/Treasurer Strecker led the Pledge of Allegiance.
    Mayor Adams led the session with informational announcements on the following items: 1. Weather updates; 2. Announcement that Goshen County is under a Stage 1 Fire Restriction Status until further notice; 3. Fourth of July weekend update; 4. Reminder to the public to be cautious and mindful of the presence of children on the streets. Request to the public to refrain from using their cell phones while driving; 5. COVID-19 updates and recommendations; 6. Reminder to the public that the baler site is open every Saturday through October from 7:00 a.m. to 3:00 p.m. to receive grass and general yard waste; 7. Reminder to the public to refrain from putting garbage in the City’s grass dumpsters; 8. Reminder to the public that pets are not allowed within the boundaries of the City’s sports fields during non-sporting events. 9. Reminder to the public that the Candy Thompson Memorial Dog Park is available for use every day of the week. Individuals who use the park are expected to pick up their animal waste and deposit it into the provided containers; 10. Reminder to the public that the Elk Eco Cycle Recycling Center is open and is accepting carboard, separated paper products and aluminum cans. The site is located at 310 Curtis Avenue and is open Monday through Wednesday from 8:00 a.m. to 4:00 p.m.; 11. Reminder to the public that the Water Department is calling City water customers to schedule appointments to identify service line types; 12. Reminder to the public that the next Music on Main Summer Concert Event is scheduled to be held on 07-13-22; and 13. Announcement that the 08-02-22 Council meeting will be held in the picnic shelter at the northeast corner of Jirdon Park at 7:00 p.m. in conjunction with National Night Out, an annual event organized by the Torrington Police Department. Hamburgers and hot dogs will be provided along with many other fun activities.  

Councilman Kelly moved and Councilman Patterson seconded to approve the consent agenda which includes the minutes from the 06-21-22 Council meeting as published and all actions therein be ratified. Motion carried unanimously.
Councilwoman Steinbock moved and Councilman Patterson seconded to approve the agenda as presented. Motion carried unanimously.
Dennis Estes with the Torrington Volunteer Fire Department requested approval of a special event permit for the 2022 Goshen County Fair Parade to be held on 08-04-22 from 8:00 a.m. to 12:00 p.m. on Main Street. Mayor Adams indicated that the applicant is requesting that the special event permit fee be waived due to the fact that the event is an annual community event. Councilman Patterson moved and Councilman Kelly seconded to approve the special event permit and to waive the special event permit fee as presented. Motion carried unanimously.
Attorney Eddington read by title AN ORDINANCE CREATING AND ENACTING CHAPTER 13.18 OF THE TORRINGTON MUNICIPAL CODE, 2022 REVISIONS, RELATING TO SURFACE WATER DRAINAGE. Councilwoman Steinbock moved and Councilman Patterson seconded to approve Ordinance No. 1263 as presented on third reading. Motion carried unanimously.
Director of Public Works (DPW) Harkins presented for approval Amendment No. 11 to the Agreement for Professional Services with Inberg-Miller Engineers (IME) for the Landfill #2 New Cell Design & Permit Renewal Project. He stated that the purpose of the amendment is for IME to continue to provide the required well monitoring, testing and state reporting to the Wyoming Department of Environmental Quality ($27,390.00), to complete the final CQA report for the closure of Cell #13 ($7,500.00), and for the continuation of the Baler permit renewal ($4,500.00). The amendment is in the amount of $39,390.00. Councilman Patterson moved and Councilwoman Steinbock seconded to approve Amendment No. 11 to the Agreement for Professional Services with Inberg-Miller Engineers (IME) as presented. Motion carried unanimously.
Attorney Eddington read by title AN ORDINANCE REPEALING SECTIONS 9.24.010 AND 9.24.040 OF THE TORRINGTON MUNICIPAL CODE, 2022 REVISIONS, RELATING TO CARRYING OF CONCEALED WEAPON AND SWITCHBLADE KNIFE. Chief of Police Johnson stated that the two sections governing carrying concealed weapons and switchblades are outdated and not a public safety issue in the community, therefore they are being proposed to be repealed. Councilman Patterson moved and Councilman Kelly seconded to approve the ordinance on first reading as presented. Motion carried unanimously.  
Attorney Eddington read by title AN ORDINANCE AMENDING AND RE-ENACTING SECTIONS 9.02.010 AND 9.02.011 OF THE TORRINGTON MUNICIPAL CODE, 2022 REVISIONS, RELATING TO PENALTIES AND JAIL. Chief of Police Johnson stated that the only amendment made to the ordinance is the addition of Obstructing a Peace Officer, Possession of a Controlled Substance, Breach of the Peace, Trespass, 2nd Offense Failure to Maintain Liability Coverage and Driving While License Cancelled, Suspended or Revoked to the list of jailable offenses. He indicated that the jailable offenses were added to allow different crimes to be tried in Municipal Court. Councilwoman Steinbock moved and Councilman Patterson seconded to approve the ordinance on first reading as presented. Motion carried unanimously.
Attorney Eddington read by title AN ORDINANCE AMENDING AND RE-ENACTING SECTION 9.36.060 OF THE TORRINGTON MUNICIPAL CODE, 2022 REVISIONS, RELATING TO POSSESSION OF A CONTROLLED SUBSTANCE. Chief of Police Johnson stated that the proposed ordinance adds all misdemeanor drug charges into the City’s code. Councilman Patterson moved and Councilwoman Steinbock seconded to approve the ordinance on first reading as presented. Motion carried unanimously.

Director of Public Works Harkins stated that the ordinance involves land that was purchased by the City of Torrington previously that was never annexed. Councilman Patterson moved and Councilwoman Steinbock seconded to approve the ordinance on first reading as presented. Motion carried unanimously.

Attorney Eddington read by title AN ORDINANCE AMENDING SECTION 1.08.010 OF THE TORRINGTON MUNICIPAL CODE, 2022 REVISIONS, RELATING TO HOLIDAYS. Clerk/Treasurer Strecker stated that the proposed ordinance is a housekeeping effort to update the City’s code to comply with the current Holidays Policy that was recently amended adding the Martin Luther King, Jr./Wyoming Equality Day Holiday. Councilman Kelly moved and Councilman Patterson seconded to approve the ordinance on first reading as presented. Motion carried unanimously.   
Clerk/Treasurer Strecker presented for approval the annual write-off of accounts. She stated that the write-offs in accounts receivable total $875.00 and the write-offs in utility billing total $8,719.72 for a total write-off amount of $9,594.72. The City Council determined the debt as uncollectable and extinguished the debt as an account receivable or asset of the City of Torrington. Councilwoman Steinbock moved and Councilman Patterson seconded to approve the annual write-off of accounts totaling $9,594.72 as presented. Motion carried unanimously.
The bills from 06-22-22 to 07-05-22 were presented for payment. Councilman Patterson moved and Councilwoman Steinbock seconded to approve the bills for payment as presented. Motion carried unanimously.
Mayor Adams asked for public comments, questions or concerns.
    Fire Chief Petsch briefly summarized the events that took place with the fire calls that the Torrington Volunteer Fire Department (TVFD) responded to during the Fourth of July Holiday. He also briefly updated the Mayor and Council on a call that the TVFD received from Goshen County Emergency Management on 07-01-22 for mutual aid assistance with the breach of an irrigation canal near Lingle, Wyoming. Lastly, Fire Chief Petsch announced that three members of the department are ready to be dispatched on a Wildland Firefighting assignment.
    Mayor Adams commended the individuals that are members of the Torrington Volunteer Fire Department who also work for the City of Torrington. He thanked them for their sacrifice and for keeping the members of the community safe.
    Councilman Patterson moved and Councilwoman Steinbock seconded that there being no further business to come before the Mayor and Council to adjourn at 7:37 p.m. Motion carried unanimously.
