    The Torrington City Council met in regular session on Tuesday, March 7th, 2017 in the City Council Chambers at 436 East 22nd Ave. at 7:00 p.m. Present:  Mayor Varney, Council Members Adams, Hill, Kelly and Law. Also Present:  Clerk/Treasurer Strecker, Attorney Eddington, Engineer Harkins, Interim Police Chief Weeks, Streets and Sanitation Supervisor Korell, Cemetery Sexton Friedlan, Fire Chief Petsch, and Deputy City Clerk Kinnan.
Mayor Varney called the meeting to order.

        Mayor Varney led the Pledge of Allegiance.
        Mayor Varney announced he received a letter from Vyve Broadband. They stated as of April 20th, 2017 they will replace the duplicate CBS station KGWN on channel 5 with the CW network from KSTF. CBS programming from KSTF will remain on channel 10.
        Mayor Varney commented representatives from the Ports to Plains and Heartland Expressway groups are currently in Washington D.C. to meet with Congressional members. Joe Kiely and Deb Cottier agreed to represent Torrington when they meet with Barrasso, Enzi and Cheney. Mayor Varney stated he is frustrated with the fourteen mile stretch of highway that needs to be four-lane east of Torrington into Nebraska.  Nebraska says they will four-lane their seven mile section east of the Wyoming/Nebraska state line when Wyoming does their side and Wyoming says they will do their side when Nebraska does theirs.  
        Councilwoman Hill moved and Councilman Kelly seconded to approve the consent agenda which   includes the minutes from the 02-21-17 Council meeting as published and all actions therein be ratified. Motion carried unanimously.    
        Councilman Adams moved and Councilman Law seconded to approve the agenda as presented. Motion carried unanimously.     
        Paul Stille with Leo Riley & Co. presented the Auditor’s Financial Report for the year ended June 30, 2016. Mr. Stille commented they had excellent cooperation from the staff and thanked them for their assistance.  He stated due to the adoption of the Governmental Accounting Standards Board (GASB) Statement No. 68 Accounting and Reporting for Pensions, the City’s financial statement must include the proportionate share of the net liability of the pension plan the City participates in, which is the Wyoming Retirement System (WRS). Currently the WRS is underfunded, so the City must reflect their proportionate share of the net pension liability. At June 30, 2016 the City’s liability was a total of $4,458,989. The City’s liability amounts will fluctuate year to year based on the rate of return on WRS pension plan investments and the total pension liability. Mr. Stille noted additional auditing was required due to the City receiving a major federal award for the Airport Improvement Program. Councilman Adams inquired about the statement in the report that says the City is a high risk auditee. Mr. Stille stated the City must have three consecutive federal audits to drop out of the high risk, in 2015 the City did not require any federal audits. Mr. Stille commented the State of Wyoming has seen tighter budgets and continued revenue shortfalls for the upcoming year. Councilman Adams moved and Councilwoman Hill seconded to accept the financial report as presented.  Motion carried unanimously.
        Attorney Eddington read by title AN ORDINANCE CREATING AND ENACTING SECTION 3.04.206 OF THE TORRINGTON MUNICIPAL CODE, 2017 REVISIONS, CREATING A POWER COST ADJUSTMENT RELATING TO ELECTRICAL RATES. He stated the Public Service Commission (PSC) approved the Power Cost Adjustment (PCA) last week. Councilwoman Hill moved and Councilman Adams seconded to approve Ordinance No. 1175 on third reading. Motion carried unanimously.
        Attorney Eddington read by title AN ORDINANCE AMENDING AND RE-ENACTING SECTION 12.36.070 RELATING TO THE SALE AND COST OF LOTS IN THE TORRINGTON MUNICIPAL CEMETERY. He commented a correction in the ordinance needed to be made regarding the size of a single lot, it should be 5’ x 10’ not 5’ x 7’. Mayor Varney commented that Staff recommended rates be increased since they have not been raised since 2012.  Councilman Law moved and Councilwoman Hill seconded to approve the ordinance as presented on first reading. Motion carried unanimously.
        Attorney Eddington read by title AN ORDINANCE AMENDING AND RE-ENACTING SECTION 12.36.095 RELATING TO INTERMENT AND DISINTERMENT COSTS IN THE TORRINGTON MUNICIPAL CEMETERY. Councilwoman Hill moved and Councilman Kelly seconded to approve the ordinance as presented on first reading. Motion carried unanimously.
         The bills from 02-22-17 to 03-07-17 were presented for payment. Councilwoman Hill moved and Councilman Adams seconded to approve the bills for payment as presented. Motion carried unanimously.
        Councilman Law congratulated Streets and Sanitation Supervisor Korell and his crew for a job well done during the recent snow storm.
        Councilwoman Hill commented the Torrington girls basketball team did not advance to the State tournament but the Torrington boys did. She encouraged residents to support the Torrington boys basketball team by attending the upcoming games.
        Councilwoman Hill moved and Councilman Law seconded that there being no further business to come before the Council to adjourn at 7:50 p.m. Motion carried unanimously.
