PUBLIC NOTICE

Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Procedural Rules, notice is hereby given of the Application Black Hills Gas Distribution, LLC d/b/a Black Hills Energy (BHGD or the Company) for approval of its tax plan to account for the effect of the Tax Cuts and Jobs Act of 2017 (TCJA).

BHGD is a public utility as defined in Wyo. Stat. § 37-1-101(a)(vi)(D), subject to the Commission’s jurisdiction pursuant to Wyo. Stat. § 37-2-112.

The TCJA was signed into law on December 17, 2017. Key provisions within the TCJA affecting BHGD’s operations are: [i] the reduction in the Federal Income Tax Rate (FIT Rate) from 35 percent to 21 percent, effective January 1, 2018; and [ii] the normalization provisions that govern the Excess Deferred Federal Income Taxes (EDFIT) that result from the change in the FIT Rate. BHGD states that these changes result in reductions in the cost of providing service and a benefit to retail customers.


On December 27, 2018, BHGD filed its Application requesting Commission approval to issue a one-time bill credit to customers in February 2019 to reflect certain FIT and EDFIT changes for 2018, and a one-time bill credit to customers in November 2019 to reflect certain FIT and EDFIT changes for 2019. The Company proposes to defer the non-protected EDFIT amortization until its next rate review filing. At that time or no later than January 1, 2021, BHGD will file a proposal to address these balances.

This is not a complete description of the Application. Interested persons may inspect the Application at BHGD’s offices or at the Commission’s offices in Cheyenne, Wyoming during regular business hours. The Application may also be viewed on the Commission’s data management system at https://dms.wyo.gov/external/publicusers.aspx.

Anyone desiring to file a public comment, statement, intervention petition, protest or request for a public hearing in this matter must so file with the Commission in writing on or before February 15, 2019. Any intervention request filed with the Commission shall set forth the grounds of the proposed intervention or request for hearing as well as the position and the interest of the petitioner in this proceeding.
