Man charged with meth possession

Eric D. Falvey, of Groveton, Texas, spent four days in the Goshen County Detention Center as the result of a REDDI report to local law enforcement. 

Falvey pleaded guilty to a misdemeanor count of possession of a controlled substance after a Goshen County Sheriff’s Deputy located methamphetamine during a traffic stop on Nov. 10. Falvey was sentenced on Nov. 21 to 30 days in jail with 26 days suspended and given credit for four days served. Falvey will also be responsible for $635 in court fees and costs. 

According the Affidavit of Probable Cause in the case, Falvey’s vehicle was spotted by an anonymous caller. The caller stated that Falvey’s car was “swerving all over the road.”

Deputy Herbert Irons, who filed the affidavit, responded to the call. Irons followed the car and observed it commit several traffic violations, which prompted him to initiate a traffic stop. 

Irons asked Falvey to step to the rear of the car. Falvey admitted that he did not have a valid registration nor insurance for the car. Irons wrote that he later learned the Falvey’s license was invalid. 

“I talked with Falvey about my intentions with issuing him citation for the current issues,” Irons wrote in the affidavit. I asked Falvey if I could pat him down for weapons and he stated that I could.”

During the pat search, Irons felt a round object in Falvey’s jacket pocket, the affidavit said. 

“At this time, I observed the ‘stem’ section of a glass pipe fall slightly out of the pocket into plain view,” Irons wrote. “As I looked at the pipe I immediately recognized it to be a pipe that is commonly used to smoke methamphetamine out of. I further observed a white, powdery substance on the inside of the pipe which I recognized to be methamphetamine residue.”

After finding the pipe, Irons placed Falvery under arrest, the affidavit said.
