Felony charges dropped against Rodriguez, Garcia

TORRINGTON – Deputy Goshen County Attorney Jeremiah Sandburg recently moved to dismiss felony sexual assault charges against Homer Botello Rodriguez because the prosecution did not believe it had sufficient evidence to secure a conviction.
Rodriguez, now a free man, was originally set to stand trial in February.
“While preparing for trial, the state determined it does not have sufficient evidence to sustain a conviction at this time,” the motion said. “Dismissal of this matter is appropriate and in the interest of justice.”
Rodriguez was originally charged with first degree sexual assault, which carries a sentence of between five and 50 years in prison.
Charges against his co-defendant, Adrian Garcia, were also dismissed.
